The Marshal and the Judge can't find anyone willing to serve on a jury at a trial of a train robber because other members of the gang are still at large and making threats.  Finally the judge tries a little known loop-hole.  When a full jury of twelve cannot be seated, a trial may be held with one juror.  Dan picks a juror at random from the unserved juror summons.  He is stricken when it's Lily's name that's picked.  But he and Johnny manage to protect her until the trial can start.
