When Dan closes the Empire Saloon for a variety of misdeeds, the owner hires a gunman to kill the Marshal.  The killer meets his old friend Dan in the public bath house Dan is not, of course, wearing his badge.  Only when they meet for dinner does he realize Dan is the Marshal he's been hired to kill.
